§ 1-12. Commitment for failure to pay fines.

  • In all cases where judgment is rendered as provided in section 1-11 in favor of the village, such person so convicted of a violation of any ordinance of the village shall be committed to the village jail or other place of imprisonment provided or authorized by the village and be imprisoned therein for failing to pay any fine, forfeiture, penalty or costs which may be adjudged against him where the defendant has waived a jury in writing or when such judgment was pursuant to the verdict of a jury, and may be required to work at such labor as his strength will permit, not to exceed eight (8) hours each day. For such work the prisoner shall be allowed, exclusive of his board, the sum of five dollars ($5.00) for each day's work or imprisonment on account of such fine, penalty or forfeiture and costs, until the same is fully satisfied; provided, no such imprisonment shall continue longer than six (6) months for any one offense. At the expiration of the term of confinement, the keeper of the place of confinement shall endorse the writ of commitment "satisfied in full by imprisonment," and discharge such person from his custody. Commitment of any person as provided in this section shall be by process, under the hand of the court which made the order for such commitment.
